1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern access to and use of LearningHowToBreatheAgain.com and purchases made through the website. The website is operated by Lamperez, LLC d/b/a Learning How To Breathe Again.

By accessing or using the website, adding products to a shopping cart, submitting an order, purchasing a product, or otherwise using our services, you acknowledge that you have read and agree to these Terms together with our applicable Privacy Policy, Shipping Policy, and Returns & Refund Policy.

If you do not agree with these Terms, you should not use the website or complete a purchase.

2. Electronic Transactions

Transactions through LearningHowToBreatheAgain.com are conducted electronically. Orders, confirmations, receipts, policies, disclosures, notices, and other communications may be provided electronically, including through the website or email.

Your use of electronic checkout and submission of an order constitutes your request to conduct the applicable transaction electronically, subject to applicable law.

3. Eligibility and Capacity

You must have the legal capacity to enter into a binding transaction in order to make a purchase through this website.

If you are not legally able to enter into a binding agreement independently, you should use the website or make purchases only with the involvement and authorization of a parent, guardian, or other legally authorized adult.

4. Website Purpose

LearningHowToBreatheAgain.com provides information concerning DJ Lamperez, Learning How To Breathe Again, the Just One More Day message, related content, and products offered for purchase.

Products may include:

  • Hardcover and paperback books
  • eBooks and digital products
  • Apparel
  • Phone cases
  • Accessories
  • Signed or special-edition products
  • Other merchandise offered from time to time

We may add, modify, discontinue, or change products and website features at any time.

5. Product Information

We make reasonable efforts to present product descriptions, photographs, colors, dimensions, sizes, compatibility information, pricing, and other product details accurately.

Actual colors and appearance may vary depending on device displays, manufacturing processes, materials, lighting, and other factors.

For apparel, customers are responsible for reviewing available sizes and variants before ordering. For phone cases, customers are responsible for selecting the correct phone model and color before submitting an order.

A product image or mockup is intended to provide a reasonable representation of the product but may not reproduce every physical detail exactly.

6. Made-to-Order Merchandise

Certain apparel, phone cases, and accessories are print-on-demand products that are manufactured after an order is submitted.

Customers acknowledge that made-to-order merchandise may enter production shortly after an order is placed and that cancellation may no longer be possible once production or fulfillment begins.

Returns of made-to-order merchandise are governed by our Returns & Refund Policy, including the requirement that a return receive authorization before merchandise is mailed back.

7. Prices

Product prices are displayed on the website or through the Shopify-powered purchasing interface.

Unless otherwise stated:

  • Prices are displayed in U.S. dollars.
  • Shipping charges may be additional.
  • Applicable taxes may be calculated during checkout.
  • Prices may change without prior notice for future purchases.

A price change does not ordinarily affect an order that has already been properly accepted and paid, except where correction is permitted or required by applicable law.

8. Pricing, Description, and Technical Errors

Although we make reasonable efforts to maintain accurate information, typographical, technical, pricing, inventory, product-description, or configuration errors may occasionally occur.

If an obvious material error affects an order, we may contact the customer before fulfillment to explain the issue and determine the appropriate resolution.

Where permitted by law, we may correct an error or cancel an affected order and issue an applicable refund rather than fulfill a transaction based on materially incorrect information.

Nothing in this section permits misleading or deceptive pricing or other practices prohibited by applicable consumer-protection law.

9. Orders Are Subject to Acceptance

Submission of an order does not necessarily guarantee that every requested product can be fulfilled.

An order may be subject to verification concerning:

  • Payment authorization
  • Product or variant availability
  • Shipping information
  • Suspected fraud
  • Technical errors
  • Order quantity
  • Fulfillment capability

We reserve the right, where permitted by law, to decline or cancel an order for legitimate reasons.

If we cancel an order after collecting payment and the customer is entitled to a refund, the applicable refund will be issued in accordance with law and our policies.

10. Product Availability

Products and variants may become unavailable, sell out, be discontinued, or encounter production limitations.

We do not guarantee continuous availability of any particular book edition, apparel size, color, phone-case model, accessory, or other product.

If merchandise cannot be fulfilled after an order is placed, we will address the affected order in accordance with applicable law and our Shipping Policy.

11. Shopify Checkout and Payments

Our ecommerce functionality is powered by Shopify. Customers may interact with Shopify-powered cart, checkout, payment, order-management, and related ecommerce functionality when purchasing through LearningHowToBreatheAgain.com.

Payment processing may also be subject to the terms and policies of Shopify and applicable payment providers.

12. Payment Authorization

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

If payment authorization fails, is rejected, reversed, disputed, or otherwise cannot be completed, fulfillment may be suspended or the order may be canceled where appropriate.

Customers are responsible for providing accurate billing and contact information.

13. Taxes

Applicable sales, use, or other transaction taxes may be calculated and collected during checkout when required.

14. Shipping and Delivery

Physical products are shipped according to our Shipping Policy, which is incorporated into these Terms by reference.

Physical book orders are generally processed within 2–5 business days.

For made-to-order apparel and accessories, customers should generally allow approximately 7–14 business days for delivery under normal circumstances.

Orders containing different types of products may be fulfilled separately and arrive in multiple packages. Customers are responsible for providing a complete and accurate shipping address.

15. Shipping Delays

Estimated shipping or delivery dates are estimates unless expressly identified as guaranteed.

Carrier interruptions, weather, customs, holidays, production delays, fulfillment problems, and other circumstances may affect actual delivery.

If merchandise cannot be shipped within an applicable promised timeframe, customer notification, cancellation, and refund rights will be handled in accordance with applicable law and our Shipping Policy.

16. Returns, Refunds, and Replacements

All returns, refunds, replacements, cancellations, damaged-product claims, and related matters are governed by our Returns & Refund Policy, which is incorporated into these Terms.

  • Share copies commercially
  • Remove copyright or ownership notices
  • Create unauthorized derivative commercial products from it
